Big Supreme Court Decisions: the Success and the Failure.

Many stories have come out this week from the Supreme Court. First, the Court upheld many states’ ban on transgender people playing sports in leagues of the opposite sex, meaning the sex that they identify as. No more biological men beating up women in sports leagues that are supposed to separate. The controversy has been focused on whether or not Title IX and the Constitution prohibit discrimination against trannies. The Court was split 6-3 on the vote with the extremist judges Sotomayor, Jackson, and Kagan siding against the ruling. Who would have thought right? Still in a “Big Win” as President Trump put it, the Court has finally decided to protect women’s rights stating the Constitution and Title IX do not allow for this abomination, but instead are meant to protect the separation of the genders in sports.
As great as that win is, it may be overshadowed by a definite defeat for Republican lawmakers as the Court ruled in favor for all Birthright Citizenship. For background information, President Trump in the many orders he signed once taking office in January 2025, signed an executive order which put constraints on the requirements for naturalization of people born in the United States. The Court ruled this executive order went against the Fourteenth Amendment to the Constitution which “grants citizenship to all persons born or naturalized in the United States, overriding the Supreme Court’s decision in Dred Scott v. Sandford (1857), which denied citizenship to African Americans.”[1] Sounds like they were making the correct decision right? Well, you could think that, but the truth is they have misinterpreted the Constitution historically and literally.
The Fourteenth Amendment was never meant to apply the way Democrat politicians have been applying it for years now. The Amendment was signed in 1868 after the Civil War to grant full citizenship and the rights included in such citizenship to black American former slaves who’s rights were curtailed by the Black Codes. Instead, Democrats under Obama and Biden have applied the Fourteenth Amendment to anyone born on United States soil to include the children of illegal immigrants, and foreigners who although legal are not citizens. Thus we’ve had the term “anchor baby” for many years now. Dems have provided through their deliberate misinterpretation of the Constitution for illegal immigrants to gain legal status through birthing children on American soil. They have allowed foreigners here legally for variety of reasons, school, travel, “Temporary” Protective Status, etc. to gain citizenship through the birth of a child even if neither of the parents are citizens. This is a huge reason for the influx of immigrants, especially legal, in recent years. Why go through the hassle of entering legally, going through the process to citizenship, or entering illegally and trying to evade ICE when all you have to do is cross the Rio Grande at 8 ½ months pregnant and then go into labor on American soil? The figures below, from the Department of Homeland Security, show the increase of naturalizations over the decades and the region they are from.[2]
Trump’s executive order said verbatim: “the privilege of United States citizenship does not automatically extend to persons born in the United States: (1) when that person’s mother was unlawfully present in the United States and the father was not a United States citizen or lawful permanent resident at the time of said person’s birth, or (2) when that person’s mother’s presence in the United States at the time of said person’s birth was lawful but temporary (such as, but not limited to, visiting the United States under the auspices of the Visa Waiver Program or visiting on a student, work, or tourist visa) and the father was not a United States citizen or lawful permanent resident at the time of said person’s birth.” Could not be clearer; however, as is typical with everyone of Trump’s orders, some liberal judge files an injunction and now the order is battled out in the courts for over a year.
Instead the Supreme Court jumps on the side of the liberal judge, against the American people, and upholds the Democrats actions to flood this country with illegal immigrants. This decision now gives precedence for the continued misrepresentation of the Fourteenth Amendment and allows for hundreds of illegal families to remain in the country as citizens instead of paying for their crimes.
